Si el empleador no mantiene a un trabajador lesionado en la nómina debido a su incapacidad para desempeñar cualquier puesto disponible, el trabajador puede tener derecho a continuar recibiendo los beneficios legales hasta que expiren.

  • El derecho a rechazar ofertas o incentivos de su empleador para evitar presentar un reclamo por lesiones laborales.
  • El derecho a estar libre de acoso por parte de su empleador debido a su lesión.
  • El derecho a no ser despedido en represalia por lesionarse en el trabajo o por presentar un reclamo por lesiones laborales.

Además, si su lesión laboral fue causada por la culpa de un tercero, por ejemplo, si un conductor negligente lo atropelló cuando conducía por razones laborales o se lesionó por un equipo o maquinaria defectuosa, también tiene derecho a presentar una demanda por lesiones personales de terceros contra aquellos responsables. Un reclamo por lesiones personales puede permitirle recuperar una compensación por pérdidas que no están disponibles bajo el sistema de compensación laboral.

¿Puedo demandar a mi empleador?

Su derecho a presentar una demanda por lesiones laborales contra su empleador en Texas depende de si su empleador adquirió un seguro de compensación laboral. A diferencia de la mayoría de los otros estados, Texas no obliga a los empleadores privados a obtener cobertura de seguro de compensación laboral.

Si bien puede resultar más fácil obtener beneficios bajo la compensación laboral, los beneficios son limitados y es posible que no lo compensen por completo por el alcance total de sus pérdidas debido a su lesión laboral. Un trabajador lesionado solo puede salir del sistema de compensación laboral en circunstancias limitadas, como si la conducta intencional del empleador causó la lesión del trabajador.

Si trabaja para un empleador “no suscriptor”, entonces puede optar por presentar una demanda por lesiones contra su empleador por una lesión en el lugar de trabajo. Por supuesto, presentar una demanda significa que deberá demostrar la responsabilidad legal de su empleador por su lesión estableciendo negligencia, imprudencia o conducta intencional.

Sin embargo, un reclamo por lesiones personales en el lugar de trabajo le permite recuperar una compensación adicional que no está disponible en la compensación laboral. En una demanda por lesiones laborales, es posible que tenga derecho a recuperar el monto total de sus salarios perdidos y ganancias futuras perdidas, además de las pérdidas intangibles que surjan de su lesión, como dolor y sufrimiento o pérdida de calidad de vida.

¿Estoy protegido si soy un inmigrante indocumentado?

Incluso si es un inmigrante indocumentado, todavía tiene algunos derechos si se lesiona en el trabajo. Puede presentar un reclamo de compensación laboral con su empleador si tiene cobertura de seguro o presentar una demanda por lesiones personales contra su empleador si no tiene cobertura de compensación laboral, independientemente de su estado migratorio.

Si presenta una demanda por lesiones laborales contra su empleador, su estado migratorio no debería convertirse en un problema en el caso. Si su empleador intenta tomar represalias contra usted por presentar un reclamo por lesiones en el lugar de trabajo al denunciarlo ante los funcionarios federales de inmigración, es posible que esté protegido de los procedimientos de inmigración durante su reclamo por lesiones laborales. Pero incluso si un trabajador indocumentado es despedido de su trabajo después de sufrir una lesión laboral, aún puede continuar con su reclamo de compensación laboral o reclamo por lesiones personales en el lugar de trabajo y recuperar los beneficios o compensación que se les adeuda según la ley, incluidos los beneficios por discapacidad o ingresos futuros perdidos si sufren una discapacidad permanente debido a su lesión laboral.

9 Safety Precautions to Take When Driving With a Baby on Board

When you’re driving, it’s always important to take extreme caution. Car accidents are one of the leading causes of death in the United States, and they are often preventable. However, the added pressure of driving your baby—arguably the most precious cargo of all—only doubles the importance of being cautious. Aside from slapping a “Baby on Board” sticker on your back windshield or bumper, here are nine ways to stay safe while driving your baby.

1. Have the Right Car Seat 

Make sure your baby is in a rear-facing car seat until they are at least one. This will support their head and neck. It’s also best to get this car seat before the child arrives so that you can be ready from day one.

2. Secure Loose Toys 

Buckle up your child’s toys so that they don’t come loose and create an unnecessary hissy fit if your baby can no longer reach them. Buckling up their favorite toys can also help instill in them early the importance of wearing a seatbelt whenever you’re in a car.

3. No Texting and Driving

This is a cardinal rule of driving no matter what—or who—you are driving. Do not text and drive. It’s also best to avoid calling or using your phone at all while driving your baby.

4. Get Feeding and Changing Out of the Way First

The last thing you want to do when driving is to have to pull over and deal with a dirty diaper or a snack. Get these tasks out of the way to reduce fussiness, distractions, and upset babies.

5. Drive Defensively

Driving defensively—not aggressively—is even more important when you have your baby with you. Stay safe, stay vigilant, and go slow.

6. Protect Your Child’s Skin and Eyes From the Sun

Consider buying a sunshade to keep the harsh rays off of your baby’s skin and out of their eyes. This can cut down any time they spend fussing, which will reduce distraction for you.

This should go without saying, but avoid drowsy driving. This is a good rule of thumb when driving anyone, or even just yourself.

8. Install a Backseat Mirror

Installing a backseat mirror will allow you to take quick and needful glances at your child while maintaining focus on the road.

What Yielding the Right of Way Means

When you go through driver’s education classes as a teenager trying to acquire your driver’s license. You learn a lot about the ins and outs of road rules. One such rule is when certain drivers on the road have the “right of way”. You may have also discussed what it means to yield the right way and when you may do this. However, if it’s been a while since your days of driver’s ed or if you are still confused about the concept, here’s what you should know about yielding the right of way.

What is the “Right of Way”?

Simply put, the right of way is a helpful determinant of who “goes first” when at a controlled intersection or 4-way stop sign intersection. Controlled intersections are those with traffic controlling infrastructure, like lights or stop signs. Uncontrolled intersections do not have these instruments.

How and When Do I Yield the Right of Way?

Yielding the right of way is simple at a controlled intersection. If you and another vehicle arrive at a stop sign intersection simultaneously, you should yield—that is, give over—the right of way to the person to your right. You can indicate this with hand signals or your headlights if needed. At uncontrolled intersections, you should always yield to the car already at the intersection or ones that arrive before you. When in doubt, you can yield to the car to your right, as with controlled intersections. If you encounter a “T-intersection,” which is when you are on a dead-end road and are turning onto a two-way road, you should always yield the right of way to oncoming traffic.

Helpful Things to Remember

There are some additional things to remember when you’re out on the road and are not sure about the right way in the situation you are in. It would be best if you always yielded: at a yield sign; to pedestrians; to visually impaired or using a guide dog; when turning left; and driving on an unpaved road that intersects a paved road.

While not necessarily admissible in court or responsible for assigning fault in car and truck accidents, police reports are still important official documents. As such, they should be complete and accurate to the best of the police and those involved with the accident’s knowledge. It is one of the first places that insurance adjusters look when they are looking to quantify damage and parse through insurance claims. If you looked through the police report from your accident and it is not correct, there are some steps to rectify the situation.

What is in the Police Report?

The police report will contain many important statements, so these must be accurate. These facts include the date, time, and location of the crash; contact information for all drivers and witnesses involved; statements from drivers and witnesses; damage to vehicles; injuries that occurred in the accident; the officer’s narrative of the crash and whether there were any citations issues; pictures of the accident scene; and a diagram if needed.

You should also provide full and accurate medical records from injuries treated from the accident. If you are correcting a statement, you should write out your accurate statement. However, it is at the officer’s discretion to change the written statement on the original report.
