Interestatal 35 y autopista 90
Braun Road y Loop 1604
Bandera Road y Loop 1604
I-10 y Loop 1604
Ingram Road y Loop 410
Loop 1604 y San Pedro Ave
Loop 410 en Rigsby Ave
Carretera Culebra y Loop 410
Loop 410 y Marbach Road
Loop 410 y West Ave
Carretera y Loop de Culebra 1604
Interestatal 35 y McCullough Avenue

What Are the Most Dangerous Intersections in San Antonio?

As more and more Texans get back on the road for commutes to and from work after a lifted stay-at-home order, the streets are bound to get more congested. Even the most adept and careful drivers are wary of certain intersections, and the San Antonio drivers are no different. While there are intersections to be aware of, you should not feel that you need to avoid these intersections altogether. Here are some of the intersections in the San Antonio area that see the most accidents, fatal and non-fatal:

  • Interstate 35 and Highway 90
  • Braun Road and Loop 1604
  • Bandera Road and Loop 1604
  • I-10 and Loop 1604
  • Ingram Road and Loop 410
  • Loop 1604 and San Pedro Ave
  • Loop 410 at Rigsby Ave
  • Culebra Road and Loop 410
  • Loop 410 and Marbach Road
  • Loop 410 and West Ave
  • Culebra Road and Loop 1604
  • Interstate 35 and McCullough Avenue

These intersections may be ones that you frequent in your everyday commute, or perhaps you’ve only driven through them once or twice. Regardless, it may behoove you to commit these intersections to memory, so that you know when you need to be extra vigilant on the road.

Why are San Antonio intersections more dangerous?

Intersections tend to have higher rates of accidents than straightaway roads, streets, or highways because intersections involve a number of vehicles moving in different directions. It is far easier for a driver to collide with another if they’re running a red light, or if they mistakenly turn without a protected arrow. Intersections without stop signs or lights can be all the more dangerous, as they depend on natural traffic flow and driver aptitude.

What should I do if I’m in an accident in San Antonio?

If you’ve been in a vehicle collision, whether you were at one of these intersections or elsewhere, you should contact a San Antonio car accident attorney. If you were injured badly or your car was badly damaged and you are not at fault, speaking with a San Antonio attorney could help you find some relief for these damages.

What to Avoid When Hiring a Workers’ Comp Lawyer in Brownsville

Suffering an injury in an accident on the job could mean the end of your career and your ability to work for a living. This is when you’ll need skilled legal assistance to fight for the full financial assistance you deserve from insurance and/or the parties responsible for your injuries.

At Herrman & Herrman, P.L.L.C., our Brownsville workplace accident attorneys help injured employees seek workers’ compensation benefits or other financial assistance for their losses. We have more than 100 years of combined legal experience and are dedicated to assisting Brownsville and Cameron County workers who turn to us after serious occupational accidents and injuries.

How would you know who to turn to for help if you were suffering from a job-site injury that put you out of work? Your bills and daily needs won’t wait. Workers’ compensation benefits may pay for your medical care and replace two-thirds of your weekly wages. In some situations, you may be entitled to seek recovery through a personal injury claim. How do you know who’s best suited to help you?

It’s important to understand the steps to take and mistakes to avoid when hiring a workers’ compensation attorney in Brownsville. Below we discuss some issues to keep in mind. If you’d like to discuss your legal options after a workplace accident, phone us at (361) 882-4357 in Brownsville or reach out online to set up a free initial consultation.

4 Mistakes to Avoid When Hiring A Workers’ Comp Lawyer In Brownsville

Here are four mistakes you can avoid when searching for an attorney to help you with a workers’ compensation claim in south Texas.

1. Avoid working with a lawyer who has limited experience with workplace injury cases.

First, you need to make sure you are dealing with an attorney who knows Texas workers’ compensation law. Unlike other states, Texas gives private-sector employers the option of whether to purchase workers’ compensation insurance. Many employers have workers’ compensation insurance, but some do not.

It’s possible that your employer may not have workers’ compensation insurance. A 2019 study by the Texas Department of Insurance said the portion of employers with workers’ comp insurance fell from 78 percent in 2016 to 72 percent in 2018, the two years with the highest subscription rates since 1993.

You might be covered by workers’ compensation. The Department of Insurance study says 82 percent of private-sector employees in Texas are covered. But among employers that do not have workers’ comp, only 64 percent of employees are covered by alternative plans that pay medical or wage benefits to injured employees.

You may need to file a personal injury claim against your employer or others to seek financial assistance for injuries and losses caused by a work accident.

You need an experienced Texas attorney who understands that you have a work injury claim. There may be multiple paths to obtain the compensation you are due. When you first talk to an attorney, he or she should speak more broadly about workplace injury claims in Texas than just about filing for workers’ compensation.

2. Don’t make the mistake of not properly researching your workplace injury/workers’ comp lawyer options.

You have many choices of legal help in South Texas. Herrman & Herrman, P.L.L.C. was established in 1992 and our attorneys have successfully resolved more than 20,000 injury claims.

Search for “workers comp lawyer Brownsville” and “workplace injury attorney Brownsville” online and read a few law firms’ web pages. (Remember, the sites marked “Ad” pay to be up top in search results.) See whether they clearly explain how they can help you. See whether they seem to understand what has happened to you and what hurdles you face. See whether they can offer you testimonials from satisfied clients on their websites.

Contact people you know who have been injured on the job to ask whether they hired an attorney. If you have used an attorney in the past for something else, ask him or her for a referral to a workers’ comp attorney.

Once you have three or four likely candidates, set up some initial consultations, and meet some lawyers.

3. Don’t fail to take use the free initial consultation.

Most lawyers offer a free consultation to give you the opportunity to determine whether he or she is the right legal professional for you and your needs. It is a chance to hear from them how they see your case moving forward.

Prepare for the meeting by thinking through the best way to summarize how and when you were injured, including whatever witnesses or documentation of the accident may exist, and your injury diagnosis.

Ask the lawyer about their experience handling workplace injury cases, how many cases similar to yours they have handled and what outcomes they have achieved. Ask them to outline how they would pursue compensation for you and how long a claim should take.

Ask what will be expected of you. Some firms will handle everything they can when pursuing a claim, but some do less. Regardless, you will likely need to sign forms and be available for questioning by the opposing side if there is a lawsuit.

And, of course, ask about the fees. For a work injury claim, you should be told that you will pay nothing up front and any legal fees will come out of money your attorneys recover for you. If they are not successful, you should not be charged a legal fee.

4. Avoid failing to follow workers’ comp rules and your doctor’s orders.

Once you have a workers’ comp lawyer, you need to do your part to keep the case on track. Insurers and lawyers for the other side will look for any reason to deny your claim, such as any evidence that you are not as badly injured as you say.

You need to make sure you have properly reported your injury to your employer in writing, including when and how it happened, and that you’ve requested workers’ compensation benefits. You need to see a doctor and follow all of his or her instructions for treatment. Your employer’s workers’ comp insurer may require you to see a doctor your employer chooses. If so, go to every appointment. Failing to keep follow-up appointments can be grounds for dismissing your workers’ comp claim or discontinuing your benefits. Tell any doctor you see about how your injury has affected your life.

Let your attorney know how you were hurt and how your recovery is going. At some point, your employer may insist on you returning to work as a condition of your workers’ comp benefits continuing. If you are not ready, your attorney can help you.

There are many ways an experienced South Texas workers’ compensation attorney can help you after a work injury in Brownsville. Please feel free to contact Herrman & Herrman in Brownsville to learn more about how we may assist you.

San Antonio Car Accident Fatalities Show Another Increase

Hearing the phrase, “Don’t be a statistic,” should bring to mind gruesome figures about the number of car accidents and fatalities caused by a myriad of issues. One such figure is this: the Texas Department of Transportation has recorded another increase in car accident fatalities in San Antonio in the year 2019.

The increase in car accident fatalities could be for a number of reasons. Directly, it means there are more vehicle collisions taking place on the San Antonio roads. This fact could be caused by an increasing reliance on cell phones for GPS and communication, weather conditions, drivers who get behind the wheel under the influence, and more. An increase in the number of deaths could also be attributed to an increase in the overall population in the area.

While we cannot control population growth as individuals, we can control the way we drive. So, if you’re hitting the roads in San Antonio, here are some ways to stay safe and avoid becoming a statistic.

First, it’s important that you are in the right state of mind to drive. This means avoiding driving if you are extremely tired if you have had any alcohol to drink, and if you are under the influence of drugs- prescription or recreational.

Secondly, do everything you can to avoid distractions when driving. Some distractions may be fiddling with your phone for directions or to change the music, texting while driving, eating, applying makeup, or conversing with friends or family in the car. Many find it helpful to keep the stereo at a lower volume, as well.

The third tip is to keep an eye on the weather and never drive if you feel concerned about its severity. Extreme rain or dense snow can make driving difficult even for the most experienced drivers. Visibility can also be an issue in these cases. If you ever feel worried about your comfort while driving because of a storm, it’s best to wait out the weather before you get on the road.

If you are ever in a vehicle accident resulting in a fatality, injury, or property damage, make sure you contact the skilled attorneys in San Antonio with experience in car accident cases.

What to Do After a Car Accident in Texas

A car accident can be a traumatic event, making it hard to have the clarity and presence of mind to know what to do immediately afterward.

If the car crash caused significant injuries, you may miss weeks of work and be left with costly hospital bills. You may have a right to seek compensation for your medical bills and related expenses from the other driver who was at fault.

The actions you take after a car accident can make all the difference in whether you have a successful car accident claim. Here are some basic steps to take after a car accident

How to Anticipate an Accident

While you can never fully prepare for the shock of another motorist slamming into your car, you can prepare in advance for what you’ll need in the aftermath of the collision. Keep copies of the documents you’ll need to produce such as the car registration and proof of insurance in the glove box. The police officer who investigates the accident will ask you for them, so you should keep them handy.

It’s also good to have a pencil and small pad of paper to write down license plate numbers, if you don’t have your phone or it’s not charged. You will still need to record the other’s driver’s registration and insurance information.

Should You Call an Ambulance?

Check on your well being and the well being of others.

  1. Check Yourself for Injuries—First things first. Check yourself over after a collision to determine the extent of your injuries and whether you need emergency medical treatment. If you do, request an ambulance or ask someone else to call for an ambulance.
  2. Check on Your Passengers—You are required to provide reasonable assistance to others injured in the accident including arranging for transportation of those injured to the hospital. Check on the well-being of the others in your car and determine if anyone needs to go to the emergency room. Request an ambulance for each injured person.
  3. Get to Safe Location— If the accident involves injuries or death, you should remain at the scene of the accident. You should get to a safe location away from active lanes of traffic when it is safe to do so. If you are involved in a crash that involves only damage to the vehicle, you should move your vehicle off the road to a safe location.

Should I Contact the Police?

You should always notify a law enforcement agency after a car accident involving an injury or death, if you suspect a driver was intoxicated or if the wrecked vehicles cannot be removed from the road. You should contact the police even after a minor accident so there is an official accident report. Having an accident report that details the particulars of the accident and identifies those involved is crucial if you need to file an insurance claim later.

Wait for the police to arrive at the scene. Don’t leave the scene of the accident before they arrive. You could be charged with failure to stop, a serious criminal charge, and face serious penalties if you drive off from a car crash involving an injury.

You should always contact the police after an accident, even a minor accident. A police report is essential to an accident claim.

Note Things Around the Scene

Gather evidence at the scene of the accident while waiting for the police to arrive. Use your phone camera to snap photos of the position of the vehicles before they are moved, the damage to the cars and your injuries. Try to take photos from a variety of angles. If there were any traffic hazards or road obstructions, such as vegetation blocking a traffic sign, that may have contributed to the crash, take photos of those. Once the accident scene is cleared, the evidence may be lost.

Take note of any security cameras or traffic cameras that may have recorded the accident. Video evidence can be useful to support your claim, but it must be preserved.

Get the names and contact information of any witnesses who saw the accident. Ask the witness if you can record a short video of the witness describing what he or she saw.

If you are unable to take photos or gather information from witnesses, ask someone else to help.

Should I Apologize If I Believe I Caused the Crash?

No, many factors may have contributed to the accident. It’s too soon to know immediately after an accident. Exchange driver’s license information, vehicle registration and identification numbers, and insurance information with all drivers involved in the accident. But avoid discussing the details of the accident with other drivers.

Understandably, you may be upset or highly excited after a crash. It’s important to keep control of your emotions. An angry outburst can make a bad situation worse. Don’t accuse the other driver of causing the accident or accept blame yourself, even if you believe you were at fault.

Do not apologize to others at the scene or try to minimize your injuries. You may be unaware of the seriousness of your injuries immediately after a crash. A surge of adrenaline may mask your injuries at the time. You may become much more aware of your injuries and soreness a few days after a collision. These types of comments, while well intended, may be used against you later by insurance companies to deny or reduce your claim.

The police will investigate and determine what happened.

Should I Call the Insurance Company?

Call your insurance company and inform the insurer that you have been involved in an auto accident. Provide the insurance company with the other driver’s name and insurance information.

Answer the insurance company’s questions honestly, but don’t engage in speculation. Don’t try to mislead the insurer about what happened because it could weaken your claim. You may need to file a claim against your own insurance if the other motorist is driving uninsured or your injuries exceed the limits of the other driver’s insurance coverage. You also will need your insurance company to defend you if the other driver files a claim against your insurance.

While you want to be forthright with your own insurer, you should not discuss the accident with the other driver’s insurance company. If you have injuries caused by the other driver, you may need to seek compensation from the at-fault driver’s insurance. You should seek the help of an experienced car accident lawyer and let the lawyer handle all communications with the insurance company. You will be at a disadvantage if you try to deal with other driver’s insurance company on your own.

Contact a Car Accident Attorney in Texas

The steps you take immediately after a car accident really do matter. If you have been injured in a crash caused by another motorist and you follow the steps outlined above, you will be better positioned to file a claim. You should not have to pay your medical bills and car repairs out of pocket. You may be entitled to collect compensation from the other driver’s insurance to cover your medical expenses, lost income, car repairs and related costs. Let us our attorneys review the details of your collision and discuss your rights to pursue a car accident injury claim. The case review is free and will provide you with an understanding of your legal options.

Rio Grande Valley Nursing Homes: COVID-19 Is Still an Issue

Though we have been dealing with the COVID-19 pandemic as a country and, more locally, in the Rio Grande Valley for well over half of the year, the pandemic remains a large and very deadly threat, especially in nursing homes and communities. As the threat remains, or even gets larger, outside of nursing homes, the probability of the virus penetrating these at-risk populations gets even higher.

If your loved one or family member is a resident of a retirement community or nursing home facility in the Rio Grande Valley, it’s a good idea to keep tabs on how well the staff and other residents of the facility are staying in line with CDC regulations to keep everyone safe and COVID-free. This becomes all the more important when you realize that nursing homes account for over 40% of the deaths from coronavirus.

If you suspect that your loved one is especially at risk of getting coronavirus or passing it on to someone else, it’s a good idea to be in touch with a lawyer in your area who has experience fighting the liability shield granted to nursing homes. Depending on your situation, your case may be able to challenge these liability shields and allow you and your family to be compensated.

While the legal liability shields granted to nursing homes in the thick of this pandemic can be good in some cases, as some COVID-19 infections are not the product of negligence. For instance, if a resident contracts the virus despite the nursing home being in line with all state and federal regulations and procedures, they have an argument against negligence.

However, if it is found out—either by you or someone else—that the nursing home your loved one is staying in is in breach of these rules and they contract the virus, you could have a case. Contact a skilled Rio Grande Valley attorney as soon as possible to talk through your options, especially if your loved one’s COVID-19 case ended in death or substantial medical bills.
